Rights of foreign investors were restored. The Court of Cassation satisfied the complaint of "AM" Law Firm
The company “Hessar” with foreign capital, invested in Armenia financial means to operate grape processing activities. Unfortunately, the company collided with abuse by the Armenian employees and presented a report, suspecting its employees of embezzling money entrusted to them.
The Investigative Committee of the Republic of Armenia has violated the company's rights, depriving the lawyer of the company David Hunanyan from the opportunity to get acquainted with the case files.
The lawyer filed a complaint to the supervising prosecutor, but the latter did not abolish the violations. Complaints have also been lodged with the Court of Common Jurisdiction and then to the Criminal Appeal Court. Nevertheless, two judicial instances also have not binding the investigator to abolish the company's rights.
Finally, the chief legal adviser of ‘'AM'' Law Firm Davit Hunanyan applied to the Supreme Court of Armenia, the Court of Cassation, which submitted the complaint to the court and satisfied it.
As a result, the company's rights have been restored and a new decision has been made by the Court of Cassation by the case number ARD1/0006/11/17, which has a directive to properly formulate such jurisprudence.
